In a very sensible move, that will doubtless save many lives, judges in NY are no longer permitted to tell people in recovery that they must stop taking methadone/buprenorphine and get into 12 step programs.

This is a massive victory, and I really hope it's going to spread across the country, as for too long judges have been acting as if they were Dr's and Substance Use specialists, and deciding that 12 step 'therapy' would cure whatever ailed them. As a result of this, many people could not access MAR, and subsequently those people died.

Hopefully this is quickly going to spread from state to state!!

And if this law had only been in place when that horrible Drug Court Judge on Long Island (the one discussed in THIS THREAD <- click there) that patient might still be alive and that father not grieving his son. GOOD ON NEW YORK GOV. CUOMO FOR SIGNING THIS LAW!

I know, I was thinking the exact same thing. No one without a license should be practising medicine, especially not some old judge who knows nothing about drugs, or substance use treatment. What they do know is third hand stigma and what they're doing is harming more people than it's ever helping.

It also gives the notion that 12 step groups are actual treatment, which really bugs me, as they're not 'treatment', they're peer support groups!

There's been many circuit court rulings which deemed it unconstitutional to court order people to 12 step meetings as they're religious by nature. A California man was awarded over a million dollars last year after he sued the prison system there for locking him up when he refused to participate in a 12 step based treatment program last year.

I'm thinking we have a link to that somewhere on the forum (or maybe it was in the Facebook group). That was a ruling by the 9th Circuit (one of the most liberal federal circuits in the country), so unfortunately it's on applicable in those states... but it still sets good precedent that can be cited. The issue with Drug Court judges practicing medicine without a license is very real and rampant... I hope this new law in NY (and a similar one in NJ) will help - that remains to be seen. I know some advocates who are very skeptical.
