This is just absolutely, positively one of the most AWESOME pieces I've read in a while... and it's even more awesome that it was published by The New York Times. That's no obsolete source or journal!! This is just so good and needs to be read and shared to the point I'm posting it in our main forum as WELL as our Links and Resources forum. That was a great read. Drug court is set up for failure. It's horrible!!!

The whole thing is horrible to me, that a judge can act almost in place of a Dr, and decide what 'treatment' a person with substance use problems should get. Judges are not Dr's, and shouldn't be telling anyone what's the best way for them to get into recovery.

At least here in the UK when people with substance use issues are sentenced, judges are more likely to use something like a DRO (Drug Referral Order), which means that the person they're sentencing has to report to their local clinic. Much better than forcing them into any kind of abstinence based recovery, although if they do want something abstinence based, they are free to choose that also.

Drug Courts weresupposed to be a good alternative to incarceration... and I suppose at the time they were a step in the right direction. The notion that someone dealing with a substance use disorder could get treatment and not jail is a GREAT practice in theory... but then the problem comes with judges start acting like they have MD's or DO's after their names and start trying to dictate WHICH treatments are appropriate and which treatments "aren't allowed," etc. Though I do think this issue is starting to move in the right direction.
